G,�ti No. 6 3 8 3 <br /> ��kESH�g'� <br /> minimum requirements providing for primary and alternate septic systems <br /> appropriately sized to treat and dispose of the combined fiows from both <br /> cabins will be required prior to issuance of building permits for the new 2,400 <br /> square foot seasonal cabin. <br /> j. The Appiicants have not proposed to construct a lake access stair. <br /> k. With a total of 5% proposed hardcovpr, the Property will conform to the <br /> hardcover limitations of 25% for a Tier 1 lot. Structural coverage fimitations <br /> will also be met with the proposed 4.6% structural coverage ievei. <br /> I. The Applicants' proposed 2,400 square foot seasonal cabin or the existing <br /> 700 square foot accessory cabin will not alter the essential character of the <br /> neighborhood and will result in minimal or no negative impact on adjacent <br /> properties. <br /> m. The Applicants' request is in harmony with the purpose and intent of the <br /> ordinance. <br /> n. The Applicants have demonstrated that enTorcing the provisions of the Zoning <br /> Ordinance deprives the Applicants of the reasonabie use of their Property. <br /> 4. The City Council has considered this application including the fi.ndings and <br /> recommendation of the Planning Commission, reports by City staff, comments by <br /> the Applicants and the public, and the effect of the proposed variances and CUP <br /> on the health, safety and welfare of the community. <br /> 5. The City Council finds that the conditions existing on this Property are pecufiar to <br /> it and do not apply generally to other property in this zoning district; that granting <br /> the varianc�s and CUP woufd not adversely affect traffic conditions, light, air nor <br /> pose a fire hazard or other danger to neighboring property; would not merely <br /> serve as a convenience to the Applicants, but is necessary to alleviate a practical <br /> difficulty; is necessary to preserve a substantial property right of the Applicants; <br /> and woufd be in keeping with tne spirit and intent of the Zoning Code and <br /> Comprehensive Plan of the City. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby grants <br /> variances to Orono Municipal Zoning Code Section 78-565 (2)(b), 78-566(3), 78-568 to allow <br /> construction of a new 2,400 square foot seasonal cabin where an existing 700 square foot <br /> seasonal cabin already exists on a Big Island Record Lot 1.57 acres in area where 5.0 acres is <br /> Page 3 of 6 <br />
