i- <br />I <br />ilV illilAuft f-■^■fthIr <br />LMCD Board of Directors October 23. 1991 <br />LeFevere said his understanding in preparing the amendment <br />was that the reference was to be lights directed to the Lake <br />which cause a navigational hazard, striking words 'on the Lake”, <br />now limited to lights on docks. <br />Babcock asked to change the motion regarding docks in excess <br />of 100' in length. <br />Grathwol and Reese accepted the changes in wording <br />eliminating the wording "Docks in Excess of 100 feet in Length" <br />in Paragraph i and eliminating the words "docks of more than 100 <br />feet in length or a" and the words "on the Lake" in Gubd. 1. <br />These changes add a new category of docks to the multiple dock <br />section. <br />Foster noted he was uncomfortable with reference to <br />"unshielded lights" being more than intended. <br />Reese expressed that lights are being installed at great <br />expense as this is being considered. He favors tlie ordinance, <br />urges Its adoption. <br />Foster moved, Slocum seconded, to refer the proposed <br />ordinance amendment back to the committee. The vote was 5 ayes <br />and 6 nays with Markus, Boswinhel, Babcock. Reese, Hurr, and <br />Owen voting nay. The motion failed. <br />The first reading of the original motion as amended was <br />approved. Foster voting nay. <br />E. Petition to Minnehaha Creek Waterslied District <br />Grathwol moved, Pillsbury seconded, to approve and forward <br />to the Minnehaha Creek Watershed District a letter petitioning <br />the reactivation of the Long Lake Creek Subwatershed storage and <br />retention project. There is no expense to the District. Motion <br />carried. <br />F. Deicing Applications <br />of theGrathwol moved, Pillsbury seconded, approval <br />following deicing applications: <br />1) New: Excelsior Park Charters, at Excelsior Park <br />Tavern multiple docks. Excelsior Bay. <br />2) Benewalit Minnetonka Yacht Club, Carson’s Bay <br />Rockvam Boat Yards, Sites 1 and 2 combined <br />Motion carried, durr abstaining. <br />3) Thibault .'eported that Creg Malik, 4908 Three Points <br />Blvd.. Mound, ka.. made application for a deicing permit. Malik <br />has a permanert dock for three boats. The LMCD does not have <br />records of anr violations in the operation of the applicant's <br />dock.Reese asksd LeFevere what LMCD'a legal basis is where the <br />applicant has been observed by two board members as storing more <br />than four boats in a dock not licensed for multiple boat storage, <br />but no written record exists of this alleged excess boat storage.
