: '* <br />p, <br />^>: <br />f-. <br />Tv:,^:- <br />:■ <br />JOINT POWERS AGREEMENT <br />FOR PRC3ECUTI0N SERVICES <br />This agreement is between the City of Minnetonka <br />("Minnetonka") and the cities of Minnetrista, Orono, and St. <br />Bonifaciua (sometimes collectively referred to as "Cities"), all <br />of %rhlch are Minnesota municipal corporations with the power to <br />cooperatively exercise municipal powers pursuant to Minn. Stat. <br />1471.59. <br />1. Purpose. Each of the Cities and Minnetonka have the <br />power and responsiblity to prosecute criminal matters within <br />their respective jurisdictions. They wish to provide for the <br />exercise of such prosecutorial powers by Minnetonka on behalf of <br />the Cities. Each of the Cities has previously contracted for <br />prosecution services with private sector law firms but believes <br />that contracting with one city to provide these services will be <br />more economical and/or efficient. <br />2. Provision of Services. Minnetonka shall provide all <br />of the personnel, office space, and supplies necessary to <br />prosecute the criminal offenses for which the Cities are <br />responsible, including enforcement of the cities' codes of <br />ordinances. In addition, Minnetonka will provide legal advice <br />and training to the Cities' departments which have law <br />enforcement and code enforcement duties. All personnel <br />providing these services will be Minnetonka employees, and <br />Minnetonka will be responsible for all employment matters <br />related to these employees, including employee benefits, <br />workers' compensation, and unemployment compensation. When <br />hiring any attorney to perform these services, Minnetonka will <br />include a representative from each of the cities, at their <br />option, in the interviews of the finalist candidates. On <br />occasion, Minnetonka may subcontract for assistance from <br />attorneys who are not Minnetonka employees. Mxnnetonka will <br />provide the identities of these individuals in advance to the <br />Cities. Personnel provided will consult with the Cities' <br />elected and appointed officials regarding policy and guidelines. <br />3. Pees. The Cities will pay the following fees to <br />Minnetonka for calendar year 1992: <br />Minnetrista <br />Orono <br />St. Bonifacius <br />$20,000 per year <br />$30,000 per year <br />$ 7,000 per year <br />For calendar year 1993, these fees will be increased by the same <br />percentage increase granted by Minnetonka to members of its <br />APSCME union for. 1993 wages. The fees will be for all of the <br />serviems described 'n paragraph 2, except that each City will be <br />responsible for ail costs of any appeal, excluding Minnetonka <br />personnel costs. Before pursuing any such appeal, Minnetonka <br />Must receive approval from the city Administrator or City Clerk
