Given the new plan# no surety would t>e <br />required as proposed by staff in recommendation 6. Manager Miller <br />indicated that# as the seconder of the motion# he concurred with <br />this explanation. Upon vote# the motion carried unanimously. <br />Manaqer Maple moved that the e^.croachment matter be referred <br />to the Violations Committee. The motion was seconded by Manager <br />Miller. Manaqer Lindley asked how the construction of the <br />townhouse would impact the encroachment parking area on the <br />development site. Mr. Jones indicated that the parking in <br />question would be eliminated# and that a new parking area would be <br />established. Manager Maple and Miller agreed to withdraw the <br />motion# in light of the fact that the encroachment would be <br />reserved as a part of the construction of the development. <br />'‘*-anaqer Miller commended the Minnehaha Oaks Association and <br />others who had testified against the proposed development. Staff further <br />indicated that all materials requested had been received and that <br />staff reconnends approval of the permit. It was moved by Manager <br />Lindley# seconded by Manager Miller# that the permit be approved# <br />bated upon recommendation of staff. Upon vote# the motion carried <br />unanimously. <br />Klocknor — Installation of 75 lineal feet of <br />oroaion protection. <br />Staff indicated that this project is located at the West Arm <br />of Lake Minnetonka# in the City of Orono. Staff recommends <br />approval of the project# pending receipt of a signed application. <br />It was moved by Lindley# seconded by Manager Maple# that the <br />permit be approved# based upon recommendation of staff.
