J <br /> �kEsHO�' <br /> A RESOLUTION APPROVING A PRELIIVIINAR�PLAT <br /> AND GRANTING A CONDITIONAL USE PERMIT TO ALLOW <br /> DEVELOPMENT AS A PLANNED RESIDENTIAL DEVELOPMENT (PRD) <br /> FOR THE PROPERTY LOCATED AT 3700 NORTHERN AVENUE <br /> -FILE N0. 13-3631 <br /> WHEREAS, Landsource, LLC, a Minnesota limited liability company <br /> represented by Todd Holmers (hereinafter the "Developer") has an interest in the property within <br /> the City of Orono (hereinafter the "City") located at 3700 Northern Avenue and legally described <br /> as follows: <br /> Ezhibit A attached <br /> (hereinafter the "Property"); and <br /> WHEREAS, on August 21, 2013 the Developer filed an incomplete subdivision <br /> application with the City for preliminary approval of a six lot residential plat of the Property, <br /> which application was considered as complete as of September 9, 2013; and <br /> WHEREAS,after due published and mailed notice in accordance with Minnesota <br /> Sta.tutes 462.358 et. seq. and the City of Orono Zoning and Subdivision Codes, the Orono <br /> Planning Commission held a public hearing for the application and reviewed it on September 16, <br /> 2013, at which time all persons desiring to be heard concerning this application were given the <br /> opportunity to speak thereon; and <br /> WHEREAS, on September 16, 2013 the Planning Commission recommended a <br /> number of revisions to the proposal including that it be processed as a Planned Residential <br /> Development(PRD); and <br /> WHEREAS,the Developer submitted two revised proposals referenced as Option <br /> 1 and Option 2 which were reviewed by the Planning Commission at a public hearing held on <br /> October 21, 2013, at which time the Planning Commission voted 7-0 to recommend preliminary <br /> plat approval for Option 1 and recommended approval for development via the PRD process; and <br /> WHEREAS, at its regular meeting of November 12, 2013 the City Council <br /> reviewed the preliminary plat optional proposals and on a vote of 3-2 directed City staff to draft <br /> a resolution for preliminary plat approval for development of Option 1 as a PRD, incorporating <br /> the appropriate findings and conditions based on Council's review; and <br /> Page 1 of 14 <br />
