SWAT CITY OF ORONO <br />ilL <br />RESOLUTION OF THE CITY COUNCIL <br />Ft4.NO. 7476 <br />4/EsHO <br />FINDINGS OF FACT: <br />Al. The analysis contained within staff memos and the exhibits attached to the aforesaid <br />memos, all minutes from the above-mentioned meetings, and all other materials <br />distributed at these meetings are hereby incorporated by reference. <br />A2. The Property is located in the RS Seasonal Recreation Zoning District. <br />A3. The Property contains 23,823 square feet or 0.54 acres in area and has a defined lot <br />width of 102 feet at the OHWL and 100.69 feet at the 75-foot setback. <br />A4. The Property is within Tier 1 and hardcover is limited to 25%, according to the <br />Stormwater Quality Overlay District. <br />A5. The Applicants have applied for the following variances: <br />a. Side Yard Setback Variance <br />b. Crowding Principal Building Variance <br />A6. In considering this application for variances, the Council has considered the advice and <br />recommendation of the Planning Commission and the effect of the proposed variances <br />upon the health, safety and welfare of the community, existing and anticipated traffic <br />conditions, light and air, danger of fire, risk to the public safety, and the effect on values <br />of property in the surrounding area. <br />ANALYSIS: <br />B1."Variances shall only be permitted when they are in harmony with the general purposes <br />and intent of the ordinance . . . ." The Applicants are proposing to construct a new <br />seasonal cabin on their Big Island property, which is consistent with the intent of the <br />ordinance. The side yard setback variances requested are reasonable considering the <br />lot size and the amount of open space provided on the property and the neighboring <br />properties and are consistent with the immediate neighborhood. The variance to reduce <br />the required 10-foot separation between buildings to 8.7 feet will not conflict with the <br />intent of the ordinance. <br />B2. "Variances shall only be permitted . . . when the variances are consistent with the <br />comprehensive plan." The variances for a new seasonal cabin which is consistent with <br />the Comprehensive Plan. <br />2
