8-Wiv-O <br />CITY OF ORONO <br />OPIL <br />RESOLUTION OF THE CITY COUNCIL <br />FtNO. 7476 <br />ESHO <br />A RESOLUTION <br />APPROVING VARIANCES FROM <br />MUNICIPAL ZONING CODE <br />SECTION 78-570 & 78-1438 <br />FILE NO. LA24-000015 <br />WHEREAS, on March 11, 2024, Patrick Sutter and Anne Sutter, a married couple, <br />hereinafter the "Applicants"), applied for variances from the City Code for the property addressed <br />200 Big Island and legally described as: <br />Lots 25 & 26, Morse Island Park, Hennepin County, Minnesota (hereinafter the <br />Property"); <br />WHEREAS, the Applicant has made an application to the City of Orono for a variance to <br />Orono Municipal Zoning Code Section 78-570 to allow reduced side yard setbacks, 26.9' on the <br />north and 26.5 feet on the south where 30 feet is required; and <br />WHEREAS, the Applicant has made an application to the City of Orono for a variance to <br />Orono Municipal Zoning Code Section 78-1438 to allow less than a 10-foot separation between <br />the new cabin and an existing shed/outhouse; and <br />WHEREAS, on April 15, 2024, after published and mailed notice in accordance with <br />Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at which <br />time all persons desiring to be heard concerning this application were given the opportunity to <br />speak thereon; and <br />WHEREAS, on April 15, 2024, the Planning Commission recommended approval of the <br />variance; and <br />WHEREAS, on May 13, 2024, the City Council reviewed the application and the <br />recommendations of the Planning Commission and City staff; and <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of Orono, Minnesota <br />hereby approves the requested variances as described above based on one or more of the <br />following findings of fact concerning the Property: <br />1
