3350 North Shore Drive <br />October 31, 1991 <br />Page 3 <br />Shortly after the Planning Commission meeting staff <br />requested that Chaska Marina provide a letter agreeing to comply <br />with parking storage setbacks, a sketch on a survey of how and <br />where employee vehicles will be parked, and a Certificate of <br />Survey accurately locating the existing structure and hardcover. <br />This information was not submitted, and a letter was sent to Mr. <br />Dunn on May 29, 1986 reiterating these requirements. <br />In late 1986 or early 1987, Chaska Marina Royale was sold to <br />Gerald Toberman. During 1987 while Toberman owned the property, <br />storage and junk violations were noted at 3340 and 3350 North <br />Shore Drive, and those violations were subsequently corrected. <br />In fact, since that clean-up in 1987 until October 1991, no <br />incidents of illegal storage on this property have been <br />doctunented. <br />Apparently in early 1990 Dunn reacquired the property at <br />3350 North Shore Drive. For some time he has been living in the <br />residence, but until mid-October of this year there have been no <br />complaints documented about commercial storage on the property. <br />Staff Request for Interim Direction <br />City staff inspected the property on October 24, 1991 and <br />hand-delivered a Notice of Violation on October 28, 1991. Mr. <br />Dunn acknowledged that the commercial use of the property is in <br />violation, and agreed to appear at the City offices on Tuesday, <br />November 5, to fill out the appropriate application forms for the <br />change to commercial use. He indicated he believed he had a <br />survey of the property and would look for it. He did not <br />specifically indicate that he would remove the offending boats.- <br />trailers, vehicl<*s and equipment within the seven day pericw <br />specified in the violation notice. <br />Pending receipt of a complete application and based on the <br />anticipated scheduling of this application before the Planning <br />Commission at their January meeting, the Council would not review <br />this request until February. Therefore, staff felt that Council <br />should give staff and applicant direction as to whether any <br />storage will be allowed on the property in the interim. <br />Unfortunately, the recent snowfall on November 1 will make <br />removal of stored boats difficult unless the weather cooperates. <br />Staff requests Council direction regarding interim use of <br />this property. Optlv^iis for action include: <br />1.Require that all commercial use of the property cease and <br />employee parking as well as all stored equipment be <br />eliminated immediately.
