Hennepin County DOT maintains the road <br />shoulder and grassed ditches between the travelled road and <br />this fence line. <br />South of the driveway into the Gregory prc perty on the west <br />side of the road the topography becomes steeper and ditches <br />are narrower and are eliminated entirely along the steep <br />hillside along the Duff property. Hennepin County DOT <br />maintains this area to approximately 27.S feet from the <br />travelled centerline. <br />19. Public use of the subject Browns Bay shoreline on Like Minnetonka <br />for other than roadway purposes has been evidenced as follows: <br />a) The subject shoreline is about 950 feet in length divided as <br />follows: <br />1) About 50 feet (6l) within the <br />owned by Gregory. <br />reserve” lot privately <br />2) About 550 feet (55%) in unplatted Section 11 along the <br />Gregory and Duff properties, all of which is within 33 feet <br />of the travelled centerline of County Road 15, and all of <br />which has been maintained by Hennepin County DOT as noted <br />above. <br />3) About 250 feet (29%) between the above areas in Section 2, <br />all of which was created from the bed of Lake Minnetonka when <br />the roadway was relocated prior to 1940 and all of which has <br />been maintained by Hennepin County DOT. But this area is <br />more than 33 feet from the travelled centerline and it is not <br />included within the right'-of<-wa^ of the recorded highway <br />plat nor is it within the originally platted "reserve* lot. <br />Ownership of this acretion area is legally disputable. <br />The entire 850 feet of shoreline has been used by members of <br />the public for fishing access for as long as anyone has been <br />7 of 20 <br />■i <br />i- <br />' <• <br />I <br />g <br />11 ■ Ailiihii.ir dAAi .JBU.M t;
