Staff can confirm applicant <br />removed the former garage loc' ad predominately in County right- <br />of-way over some 10 years ago. No City has the right to ask for <br />a structure to be removed unless it is in a deteriorated or <br />hazardous condition. In the case of this structure, because of <br />its location in the right-of-way, the Department of <br />Transportation would probably have recommended that it be rebuilt <br />out of the County right-of-way. The original garage was a single <br />stall garage. The County right-of-way has served as a parking <br />area f; r this property these last 10 years. It should also be <br />noted uhat all of the properties along North Shore Drive make <br />similar use of the County right-of-way.
