The Planning Commission reviewed this application on September 16, 2013 <br /> and on a vote of 7 - 0 recommended approval of the variances, based on the <br /> following findings: <br /> a. The Property has approximately 14,467 square feet (0.33 acre) acre in <br /> area and has 52 feet in width. <br /> b. The Property is located in Tier 1 of Orono's Stormwater Quality <br /> Overlay District and is limited to 25% hardcover based on gross lot <br /> area. <br /> c. The Property does not have adequate width to construct a side-load <br /> garage. <br /> d. The Applicants propose to move the new detached garage 20 feet <br /> away from the road, 20 feet further than existing, in order to <br /> accommodate off-street parking and to create a safer entrance to the <br /> garage. <br /> e. The location of the proposed detached garage results in additional <br /> driveway hardcover. <br /> f. The proposed detached garage will meet the 10 foot side yard setback <br /> requirements. <br /> g. The topography of the Property combined with an existing mature tree <br /> serves as a practical difficulty preventing the garage from being <br /> constructed at the 30 foot setback as required. Significant filling would <br /> need to occur to place the garage at the conforming setback. <br /> h. Construction of the detached garage at the conforming setback would <br /> further impact the light, air and open space for the neighbors currently <br /> provided by the current plan. <br /> i. The Applicants have proposed to install vegetative screening along the <br /> north/lake side of the detached garage to screen the additional garage <br /> massing from the adjacent property. <br /> j. The Applicants' request will alleviate a practical difficulty inherent to <br /> Page 2 of 5 <br />
