City Administrator <br />FROM:Jonn R* Gerhardson, Public Works Director <br />DATE:Septemoet 19» 1991 <br />SUBJECT: Appeal Staff Decision - Park Dedication Fee <br />in June of 1990 Carol Kelly, 3020 Casco Point Road received <br />preliininary approval of a suodivision as per Resolution 2816 <br />(attached). That resolution stated that the park dedication fee <br />would be $440.00 as per the old park dedication fee schedule. <br />The applicant was unable to complete the subdivision and <br />therefore had to reapply, thereby allowing the City to apply the <br />park dedication fee as per the new fee schedule. <br />The park dedication fee under the current ordinance requires the <br />assessor to appraise the value of the land and to place an 8% <br />park dedication fee. In this case $7,280 (see attached <br />appraisal). <br />The applicant requested a review of the appraisal from the <br />assessor because the property has not sold and she has been <br />adivised that the price is too high. <br />The assessor has performed another review of the property and has <br />stated that he may have appraised the land too high. <br />I have received an opinion to determine flexibility in the <br />ordinance and have been told that once we establish an amount the <br />only way the amount can be changed is for the applicant to have <br />an official appraisal done by a private firm. <br />The applicant is appealing the staff decision on the following; <br />1. The applicant wishes to be allowed to fall under the <br />old park dedication fee ($440.00). <br />2. The applicant wishes that if she is allowed the old <br />fee of $440.00 that the fee be paid at time of building <br />permit issuance. <br />3. If the Council does not allow the old fee then <br />Council should allow staff to lower the appraised value <br />and that amount to be paid at the time of issuing a <br />building permit. <br />4.
