Woodhill grants to Orono the <br />eanitary ••wor sassnent described on Exhjhit -B attached hereto. <br />5, of Improvement. Upon completion of <br />oofiB^ruetlon of the Improvement and acceptance thereof by Orono, <br />Moodhill shall convey o%mership of the improvement to Orono <br />pursuant to ths Bill of sale attached hereto as • Upon <br />dalivary of the said Bill of Sale, orono shall assume sole <br />oimarahlp of the improvement. The improvement shall be part of <br />the Orono municipal eewer system. <br />6. sewer Service and Maintenangfl> After complet.on of <br />construction of the Improvement, Orono shall continually supply <br />sever aervice to Woodhill. After Woodhill conveys the <br />Improvsnant to Woodhill by Bill of Sale, maintenance, repair and <br />replacement of the Improvement from woodhill to Ruesell Avenue <br />will be the responsibility of orono at Orono's sole expense. <br />Maintenance of the system within Russell Avenue will remain the <br />reaponaiblllty of Orono. <br />7. service Charges. The Metropolitan Waste Control <br />Commission presently pays the operating cost of the sewer service <br />•ystmm and ehargaa Orono for such expenses by rates and <br />prooaduraa astabllshed by the Metropolitan waste control <br />Commimaion. Orono determines what users are charged for the <br />service, woodhill shall pay to Orono the same sewer rate <br />ss is charged to orono reeldonts for sanitary sewer service. The <br />rate may be changed by Orono from time to time by resolution. <br />Orono will inform Woodhill at least annually of ouch rate and <br />make available the eewer service budget. <br />8. Mmtsrs. Orono and the Metropolitan Waste Control <br />Commission will have access to motors on Woodhill property for <br />inapacstion and verification of readings. <br />9. m^gmistlon of Use. Woodhill agrees to regulate and <br />control iba uaa of the Improvement so as to prevent the discharge <br />of iteme into the Orono eewer system which are in violation of <br />Orono ordinances. In cass of any continuing violation of such <br />ordinances, aftar reasonable notice, Orono shall havs ths option <br />to suspend service until sucn violations are corrected. <br />10, Lift Pump Upgrade. Orono presently maintains a lift <br />pump in its sanitary sewer line located approximately 800 feet <br />east of Orono Orchard Road and as shown on Kxhib1t A. The <br />present users of the sewsr (i.e. excluding Woodhill and other new <br />umars) hava paid for such lift pump. If thxs particular lift
