LINDQUIST & VENNUM <br />Orono Planning Conmission and City Council Menbers <br />November 12, 1990 <br />Page 2 <br />2. <br />3. <br />limited membership to 60 shareholders, the number of <br />individual users could be approximately 130. <br />Obviously, the site is not large enough to sustain <br />either 180 or 600 individual users. Moreover, Orono <br />Ordinance § 10.31, Subd. C indicates that a Day-Use <br />Recreation Area Conditional Use Permit shall be granted <br />only if five acres of dry buildable land area is <br />available to sustain 100 users. If more than 100 <br />individuals may use the property, the ordinance <br />requires a ratio of one acre per every twenty users. <br />While we are unaware of the precise acreage of this <br />subject parcel, Mike Gaffron indicated that the site <br />probably does not equal, and in any event, does not <br />exceed, five dry buildable land acres. Given this <br />fact, Big Island, Inc.'s current and potential <br />membership far exceeds the lawful number of users for <br />the site. Such an overuse of the property will <br />obviously result in increased noise and destruction of <br />resources. Solely on the basis of the overcrowding of <br />the subject property, the Ericksons strenuously object <br />to the granting of the Conditional Use Permit. <br />Environment. Two hundred family unit members would <br />likely result in potentially 200 boats for the <br />property. The sixty family members current on record <br />will immediately result in at least 60 boats. The <br />shoreline area proposed for use by Big Island, Inc. <br />cannot sustain docks or boat slips for 60 or 200 boats. <br />Even if the area were sufficient in size to accommodate <br />a large number of boats, significant docking and the <br />resulting heavy boat traffic would have a severe impact <br />upon the remaining ecological system of Big Island. On <br />the basis of this environmental concern, my clients <br />object to the granting of the Conditional Use Permit. <br />Sewage Facilities. Orono Ordinances require sufficient <br />on-site sewage treatment facilities. My clients are <br />sure that, as Planning Commission and Council Members, <br />you will carefully review the proposed plan to ensure <br />that it can satisfactorily sustain the large number of <br />Individual users which Big Island, Inc. proposes. As <br />you know, sewer systems on the island have been <br />problematic. The Ericksons' concern is to eliminate <br />any further destruction of the island, its underground <br />water system, and the surrounding lake area due to <br />potential overuse of an inadequate sewer system.
