i: <br />ORONO CITY COUNCIL MEETING HELD JULY 22, 1991 <br />(#4)LAKE MINNETONKA CONSERVATION DISTRICT REPORT <br />Orono's LMCD Representative, JoEllen Hurr, was present. She <br />reported that Lakeside Marina did reduce the length of their <br />docks to 200 feet from 600 feet. Hurr advised that she would be <br />serving on an ethics committee in conjunction with the LMCD. She <br />stated that concerns have been raised about potential conflicts <br />of interest involving various persons and issues before the LMCD. <br />Hurr stated that the Mayor of Orono, and Gen Olson will serve on <br />the committee in addition to other persons outside of the LMCD. <br />The ethics committee will study the various licenses and fees <br />imposed by the LMCD. Hurr said, "I strongly believe that the <br />fees and services of the LMCD should be paid by the users of the <br />lake, and those requesting special events. The lakeshore <br />communities should not have to subsidize the various property <br />owners, businesses, etc. I have taken a position for years that <br />if fees total more than what was initially paid, then the <br />difference should be billed back to the party incurring the <br />services. There is no reason why the cities should pick up the <br />extra attorney fees for an application that requires additional <br />work Cl supervision." <br />Hurr informed Council that the annual LMCD lake outing is <br />scheduled for August 3, 1991. <br />Jabbour stated that he is disappointed with the LMCD's <br />$100.00 late fee that is charged to marina operators who do not <br />apply for their license in a timely manner. He said, "It is <br />financially advantageous for a marina operator to wait to apply <br />for a license. They receive more interest on their money that <br />would otherwise be used for licensing fees. The City of Orono <br />requires persons who need after-the-fact permits to pay a double <br />fee. It may also be appropriate for the LMCD to establish <br />inspection fees. That way, persons who comply immediately and <br />require only one or two inspections are not paying fot those that <br />must have several inspections." <br />Hurr agreed with Jabbour, adding that with the budget <br />restraints that all of the cities are under, it is increasingly <br />important for the LMCD to do whatever possible to lessen the <br />amount each city must pay to the LMCD. <br />Jabbour commended the LMCD Board of Directors for their <br />conservation attitude reflected in the revised Management Plan. <br />Hurr indicated that she had nothing further to report. <br />Mayor Peterson and Council thanked Hurr for her report. <br />PUBLIC COMMENTS: None. <br />- 5 -
