Judd, Esq. <br />Big Island, Inc. <br />RE: Requirements for Conditional Use Permit <br />Day Use Recreation Area <br />Orono City Code 10.31, Subd. 3C (1-9) <br />(1) The average number of weekday users is less than 10, and <br />the average number of weekend users is less than 20. <br />There are three days or functions during the year. <br />Memorial Day, Fourth of July and Labor Day, which usually <br />result in 50-60 users and may approach 80 on an <br />exceptional holiday. As Big Island, Inc. hosts these <br />functions on an RSVP basis, it could advise the City of <br />Orono if it expects more than 100 users for any given <br />function. <br />(2) The shoreline width exceeds 200 feet. <br />(3) The joint-use dock license from the City has been applied <br />for and the application is in the process of being <br />submitted to LMCD, Further, the number of slips do not <br />exceed the limit of one slip per 50 feet of shoreline. <br />(4) The swimming area is suitably marked and it is presently <br />situated inside marker buoys. <br />(5) The on-site sewage treatment is a septic system which has <br />been Inspected by the City. <br />(6) All buildings or structures are existing and no new <br />structures are intended to be built in the foreseeable <br />future. If any are to be constructed, the City would be <br />advised through the permit procedure. <br />(7) The property is presently provided with a telephone line, <br />and a service is being installed for emergency use. <br />(8) It la my understanding that the subject property complies <br />with Paragraph 8. <br />(9) The property will be legally combined into one tax parcel <br />when title to the property so allows; however, in the <br />interim, a special lot combination form has been prepared <br />and has been submitted for approval. <br />6696.304/06.118
