ORONO CITY COUNCIL MEETING HELD JULY 22, 1991 <br />(flO)ZONING FILE #1667-MACMILLAN CONTINUED <br />that the Planning Commission had recommended approval of the <br />MacMillan's application for a Variance to the City's Clean Fill <br />Ordinance. <br />Jabbour asked the City Attorney whether the City would be <br />liable# if in the future, it is discovered that hazardous <br />materials were buried in conjunction with this application. <br />Barrett replied, "My understanding is that both the Federal <br />and State hazardous waste laws would not hold the City liable for <br />hazardous materials." <br />Goetten o ked for assurance that any future <br />owners/developers of this property will be notified of the fact <br />that the building materials are buried on the site. <br />Kabusth advised that covenants will be filed v/ith the chain <br />of title for this property which will serve as a method of <br />notification. <br />It was moved by Jabbour. seconded by Coetten, to adopt <br />Resolution #2993, granting a Variance to the City's Zoning Code <br />Section 10.03, which allows manmade materials to be buried at <br />1700 Fox Street. All voted aye. Motion passed. <br />ENGINEER'S REPORT: <br />'V- <br />I.; <br />t <br />(|11*)REQUEST FOR PAYMENT #8-PUMPHOUSE #2 <br />It was moved by Goetten, seconded by Mayor Peterson, to <br />authorize the payment of $11,437.53 to Richmar Construction for <br />work done for the Pumphouse #3 project, as set forth in Request <br />for Payment #8. All voted aye. Motion passed. <br />(#12)HCCULLEY ROAD MSA PROJECT-ADVERTISE FOR BIDS <br />Bernhardson referred Council to John Gerhardson's memo dated <br />July 16, 1991, which outlines the reason and estimated cost for <br />the installation of storm sewer on McCulley Road. <br />•Tt was moved by Mayor Peterson, seconded by Jabbour, to <br />direct the City Engineer to advertise for bids for the storm <br />sewer project #152-104-03 on tlcCulley Road. All voted aye. <br />Motion passed. <br />MAYOR/COUNCIL REPORT: <br />OTHER <br />Mayor Peterson reminded those in attenaance of the farewell <br />dinner being held in honor of Mark Bernhardson. She advised that <br />she would be unable to attend the meeting, and wanted to take <br />this opportunity to thank Mark for all his help.
