I' ^i- <br />► U-te; <br />P <br />;■ <br />t:r- <br />r. <br />I <br />i' <br />>k- <br />_! ■ <br />A RBSOLOTION GRAHTING <br />VARIANCES TO <br />MUNICIPAL SONING CODE <br />SECTION 10.27, SUBDIVISION 5 (B) <br />PILE 11642 <br />WHEREAS, Keith and Nola Swanson (hereinafter 'the <br />applicants") are owners of the property located at 75 Stubbs Bay <br />Road North within the City of Orono (hereinafter "City") and <br />legally described as follows: <br />Exhibit A, attached (hereinafter "the property"); and <br />WHEREAS, the applicants have applied to the City for <br />variances to Municipal Zoning Code Section 10.27, Subdivision 5 <br />(B) to permit the construction of a new single family residence <br />on a lot of aro'» 2.006 acres and lot width 204' in the RR-IA <br />zoning district where lot area of 5.0 acres and lot width of <br />300* are normally required, and requesting a side yard setbaclc <br />variance of 10.1' to allow the new residence to be constructed <br />39.9' from the south side lot line where a 50' side yard setback <br />is normally required. <br />HOW, THEREFORE, BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #1642. <br />2. The property is located in the RR-IA Sinale Faunily Rural <br />Residential Zoning District, which normally requires a lot <br />area of 5 acres and a lot width of 300' for construction of <br />a residence. <br />3. The Orono Planning Commission reviewed this application <br />on May 20, 1991, and recommended approval of the proposed <br />variances on a vote of 6~1 based on the following findings: <br />A) The existing house on the property has an extremely <br />substandard side setback, being about 10' from the <br />south side lot line. Construction of a new residence <br />39.9* from the side lot line will be a significant <br />increase in conformity, as opposed to applicants' other <br />option of adding to the existing house. <br />Page 1 of 4
