I <br />Zoning File #1642 <br />May 15, 1991 <br />Page 2 <br />3.The hardship stateirent provided by the applicant indicates <br />that, regarding lot area, he has purchased the only <br />available adjacent vacant land and no other land is <br />available. Septic testing confirms that the only feasible <br />drainfield sites are mostly within the newly purchased <br />property. Regarding lot width, the applicant notes that the <br />lot is long and narrow. The defined front lot line has <br />historically, and will continue to be, along Stubbs Bay <br />Road, where the driveway is located. <br />4.The 10' side setback variance is requested specifically at <br />the suggestion of staff, to provide more of a buffer between <br />the alternate drainfield site and the proposed house <br />location. While placing the house at the 50' setback would <br />still leave a 25* setback from the alternate site (meeting <br />the minimum 20* septic-to-house setback required by code), <br />the mound site is uphill from the house and has a slope of <br />10%. Because treated effluent from this mound would <br />generally run underground towards the house, any additional <br />buffer zone between the mound and house will help to reduce <br />the potential for any additional groundwater impact on the <br />basement . <br />Discussion <br />The lot area and width for this property are fixed, and <br />can't be expanded to meet the 300'/5 acre standards of the RR-lA <br />zone. The fact that there is an existing house on the property <br />and that the existing house has extremely substandard setbacks <br />compared to the 5 acre zone standards, may put this application <br />in a better light than if the property was currently vacant. <br />This property was not zoned until 1957, when the "Residual" <br />zoning district was created with no designated lot size or width <br />limitations. Subsequent ordinances required lot sizes of minimum <br />1 acre and 140* width, until the 1975 rezoning changed this to a <br />5 acre zone. It should be noted that this property is directly <br />across the street from the RR-IB, 2 acre zone. <br />Septic System Pijcussion <br />Regarding the septic system, the existing house has a 30 <br />year old functional but substandard septic system. Two new <br />drainfield sites have been tested and systems have been designed <br />for each. Both those sites approach the slope limitations for <br />the type of system proposed. <br />I i
