Bjorlin seconded, to reconsider the approval <br />of the 1991 multiple dock licenses and to remove the -/.celsxor <br />Park Tavern from the list. <br />Grathwol asked for defeat of tlie motion. The procedure <br />proposed allows for an orderly handling of the license and allows <br />room for negotiation with the Excelsior Park Tavern. <br />The motion failed on a show of hands. <br />Grathwol moved. Babcock seconded, to approve a $U'h deposit <br />refund to Harrison Harbor Twin Homes Associates. Motion carried <br />unanimously. , , . *lGrathwol was excused at the conclusion of the Water <br />Structures Committee report. <br />Advisory Committee, Chair Rascop <br />Foster and Bjorlin were excused during the <br />discussions. „ ,1. Long Term Management Program Exchanges with Cities <br />following <br />a. <br />b. <br />Proposed amendments to Shoreland portion <br />of Underlying Principles <br />Proposed amendments to Shoreland Grant Agreement <br />James Uttley, Metropolitan Council. facilitator for the <br />Management Plan. reported on the modifications made in the <br />Shoreland portion of the Underlying Principles of the Management <br />Plan following the 4/17/91 meeting at Mound. A copy showing the <br />modifications was distributed along with a re*draft of the <br />ShorelanI Grant Agreement. Uttley reported a compromise was <br />reached at the meeting with six cities at Mound April 17 to <br />remove Appendix 'C” from the Plan and place it in the working <br />papers, as a model ordinance, available for the cities to use.^^ <br />Babcock expressed his opinion that by removing Appendix ‘*C‘* <br />the Board is in disagreement with its approval of the Management <br />Plan. His concern is that seven cities have signed the <br />Shoreland Grant Agreement including Appendix "C", and they should <br />be included in the decision to remove it. <br />LeFevere responded that removing "C“ from the Management <br />Plan does not change the Shoreland Grant contract with those <br />cities which have approved it. It will be necessary to amend the <br />Plan if this change in the underlying principles statement is <br />made, along with other references to Appendix “C" in the text. <br />Uttley went on to say this is a statement of LMCD Management <br />Plan philosophy. Another change is tb-;. the Technical Committee <br />will perform a technical review. Upon completion of the <br />technical review the city shoreland Ordinance drafts will go <br />back out to all the cities. It is then that the adjacent cities <br />can take formal action. Even if the cities do not have veto <br />power over an adjacent city's ordinance, they can proceed to <br />request further hearings beyond DNR to make their case. <br />8
