The outcome of the discussions is the committee <br />recommendation that the Excelsior Bay^ Associates becomes an <br />outlot association as it has been from the beginning and <br />continues to operate as it had been from the beginning. Chapman <br />Place originally was a commercial marina. <br />•uvr noted that under the Management Plan, outlot <br />iations are not considers desirable. Foster responded that <br />j Management Plan object-.^es for higher densities develop on <br />the lake, the outlot option cuuld be eliminated. <br />Rascop asked whether the exclusions in the definitions would <br />open an opportunity for someone to buy a coiT..;iercial marina and <br />convert it to a condominium dock. LeFevere responded that the <br />effect of the ordinance is to make " -ore difficult. It closes <br />loop-holes in the original ordinance, and he does not believe it <br />creates any new ones. <br />Grathwol moved, Cochran seconded, to waive the readings and <br />adopt and order published An Ordinance Relating to Conversion of <br />Use of Non-Conforming Docks and Structures in L-=;ke Minnetonka; <br />Amending LMCD Code Section 2.11, Subd. 2 and Adding New <br />Subdivision 5 to Section 2.11. Motion carried unanimously. <br />5. Consent Agenda <br />Grathwol moved, Foster seconded, approval of the following: <br />Chapman Place license renewal, including temporary low <br />water variance, and license management agreement and <br />amenities review with concluding recommendation by 1/93 <br />as recommended for approval by the Committee <br />Windward Marina, Inc., 1991 license renewal ^ and <br />temporary low water variance to maximum cf 260* to <br />accommodate 4‘ keel boats, less extension if possible, <br />applicant to show just cause for low water extension <br />over 40’. <br />Multiple Dock Licensse renewals without change: rig <br />Island Vets Camp; Cedar urst Assn.; Jennings Cove Dock <br />Owners Assn.; Lafayette Ridge Homeowners Assn.; and <br />Loring Acres. <br />Multiple Dociw Licen.re renews* with minor change- Boat <br />Rentals of Minneto? ..a; Shore, e Drive Marina & Yacht <br />Club including 385 fee refund; and Tonka Bay Marina <br />subject to $240 payment e 1990 license fees.
