It <br />I.MCI) Hoard of Directors April 24, 1991 <br />. • • • • H I URobert Albright, WYC, noted tnat the <br />compliance with the CUP according to the city's <br />July. ’90. and in Oct., the WYC advts,. the city in <br />came into <br />direction in <br />a letter that <br />stayed in exact compliance and had placed the buoys in <br />location. In March the Club sent a letter to the city <br />site plan similar to the one in the LMCD renewal <br />ion meeting the ingress/egress conditions and the 400* <br />it had <br />proper <br />with a <br />appliCv <br />permxt^^^^^^^ asked if there is a mooring field acceptable to the <br />city and the WYC. Albright responded very definitely there is.^ <br />Martinson concurred this is true, but from ^^he city s <br />perspective IL is subject to executing a new CUP on the <br />properties^^^ noted that if an applicant complies with all of <br />t.MCD ordinances. LMCD would grant them a permit. He does not <br />understand the position of the city, asking that their zoning <br />problems be interjected into LMCD’s lake regulation problems. <br />Grathwol suggested LMCD should reach agreement on its lake <br />matters and have the city resolve its zoning matters. <br />•'SQH S2iid 'the city wants LMCD to b© aware oi the tact <br />that it has a dispute, and it sees the LMCD as an administrative <br />extension of the councils around the lake. The question the city <br />poses is, does LMCD want to approve a permit where the applicant <br />is not in compliance with the zoning issues which surround that <br />niece of property? <br />Cole responded that what the city wants the WYC to do, the <br />WYC thinks they are not entitled to do. The WYC wants a fair <br />hearing befove another body to resolve the issues. <br />Notion: Martinson moved, Hurr secon i, to approve the <br />multiple dock and District Mooring Area renewal applications of <br />the Waysata Yacht Club showing site plan detail received 12/3/90, <br />subject to receipt of a CUP agreeable to the City of Wayzata and <br />the Wayzata Yacht Club. j <br />Asmndaent: Cochran moved, Babcock seconded, to amend tne <br />motion by striking the part of the motion starting with the word <br />“subject". - .1 j <br />Vote on Anendaent: The amendment to the motion tailed. <br />AsMindaent: Foster moved, Hurr seconded, to amend the motion <br />by striking the part of the motion starting with the <br />“subject” and substituting "subject to a valid CUP for the WYC. <br />Motion carried. <br />Notion as Amended: That the Wayzata Yacht Club renewal <br />applications for Site I and 2 multiple dock licenses. District <br />Mooring Area license, and the temporary low water variance <br />application per the site plan detail received 12/3/90, be <br />approved, subject to a valid conditional use permit for the <br />Wayzata Yacht Club. Motion carried, Martinson voting nay. <br />Duane Markus, Wayzata, voiced his objections to the Board <br />action, and also expressed his belief that some Board members <br />have acted on this matter with a conflict of interest.
