1' <br />I' <br />k <br />D) The applicants have indicated that they request no <br />hardcover variance and will construct the new residence <br />to meet Orono's hardcover regulations. <br />E) The applicants have agreed to redefine the average <br />lakeshore setback line by the points on adjacent <br />neighboring houses indicated on the site plan attached <br />as Exhibit A. This redefinition takes into account the <br />angled nature of the Mitchell residence at 2685 North <br />Shore Drive and moves the average lakeshore setback <br />line landward, therefore providing additional <br />protection of the Mitchells* lakeviews and more than <br />meeting minimum City requirements. <br />5. The City Council finds that the conditions existing on <br />this property are peculiar to it and do not apply generally <br />to other property in this zoning district; that granting the <br />variances would not adversely affect traffic conditions, <br />light, air nor pose a fire hazard or othei. danger to <br />neighboring property; would not merely serve as a <br />convenience to the applicants, but is necessary to <br />alleviate a demonstrable hardship or difficulty; is <br />necessary to preserve a substantial property right of the <br />applicants; and would be in keeping with the spirit and <br />intent of the Zoning Code and Comprehensive Plan of the <br />City. <br />OOMCLD8IOH8, QRDBR AMD COMDITIOMS <br />Based upon one or more of the findings noted above, the <br />Orono City Council hereby grants variances to Municipal Zoning <br />Code Section 10.23, Subdivision 6 (B) to allow construction of a <br />new residence on a lot 118* in width where 200* in width is <br />nonsally required, being 1.01 acres in area where a 2.0 acre lot <br />area is normally required, and allowing a 24.5* east side lot <br />line setback where a 30* side setback is normally required, <br />subject to the following conditions: <br />1. Prior to issuance of a building permit, applicants shall <br />provide the following: <br />A) Certificate of Survey verifying the iocatior, of the <br />neighboring residences at 2655 and 2685 North ^h^>re <br />Drive, and verifying that the proposed house location <br />meets the redefined average lakeshore setback line <br />indicated in Exhibit A. <br />B) Site grading plan, indicating existing and proposed <br />contours, to be reviewed by the City staff as part of <br />the normal building permit review process. <br />Page 3 of 5 <br />i
