A RESOLUTION GRANTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.40, SUBDIVISION 6 (E) <br />PILE #1635 <br />WHEREAS, John O'Sullivan and Erwin Smith (hereinafter <br />"the applicants") are owners of the property located at 2420 <br />Shadywood Road within the City of Orono (hereinafter "City") and <br />legally described as in Exhibit A, attached (hereinafter "the <br />property"); and <br />WHEREAS, the applicants have applied to the City for a <br />variance to Municipal Zoning Code Section 10.40, Subdivision 6 <br />(E) to permit the construction of a 10'x25' concrete bloc)c <br />addition to house equipment needed for upgraded car wash and <br />additional storage area along east side of existing structure to <br />be placed 8' instead of the required 15' from the side lot line. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #1635. <br />2. The property is located in the B-1 Retail Sales Business <br />District. <br />3. The Orono Planning Commission reviewed this application <br />on April 15, 1991, and recommended approval of the proposed <br />side setback variance based upon the following findings: <br />A) Additional storage area could not be provided <br />beneath the existing structure because of restricted <br />access and water table problems. <br />B) Equipment and chemicals to be stored would freeze <br />if stored on top. Structure would be an eyesore and <br />destroy exterior design of building. <br />C) The computerized equipment to be installed with <br />upgraded car wash may be damaged with moisture if it <br />were to be located within car wash structure. <br />Page 1 of 4
