o o <br />% & ■ ^ <br />CITY of ORON <br />RESOLUTION OF THE CITY COUNCIL <br />NO.________________ <br />A RBSOLOTION DENYING <br />VARIANCES TO MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIVISIONS 9 (C) « (D) <br />PILE NO. 1629 <br />NHBRBAS, the City of Orono is a municipal corporation <br />organized and existing under the laws of the State of Minnesota; <br />and <br />WHEREAS, pursuant to State Statutes 412 et.seq. and 462 <br />et. seq., the City Council of the city of Orono has adopted a <br />Conmunity Management Plan and zoning regulations for the <br />protection of the public healthy safety and general welfare; and <br />WHEREAS, Craigbank Associates represented by W. Duncan <br />MacMillan (hereinafter "the applicants") are owners of the <br />property located at 1700 Fox Street within the City of Orono <br />(hereinafter "the City") and legally described as follows: <br />Exhibit A, attached (hereinafter "the property); and <br />WHEREAS, the applicants have applied to the City to <br />permit the construction of additions to an existing sports <br />center/recreational accessory building. Such additions require <br />the following variances: <br />A. Individual accessory structure footprint area <br />exceeding the 3,000 s.f. allowed for this property per <br />Section 10.03, Subdivision 9 (C). <br />B. Total of all accessory structuze footprint areas <br />exceeding the 6,000 s.f. allowed for this property per <br />Section 10.03, Subdivision 9 (C). <br />C. Additions to accessory structure are located closer <br />to the front lot line than the principal residence <br />structure on the property, contrary to the requirements <br />of Section 10.03, Subdivision 9 (D); and <br />WHEREAS, the City Council has reviewed the application; <br />the recommendations of the staff and Planning Commission; and the <br />comments and written statements of the applicants and the <br />applicant's agents. <br />Page 1 of 9
