The City Attorney in 1987 gave the opinion (Exhibit <br />D) that the intermittent occupancy of the principal residence on <br />the property does not diminish its status as the principal use or <br />structure on the property. <br />Staff Ke<tndation <br />Staff has completed drafting a resolution for denial, which <br />is attached. However, staff would recommend tabling adoption of <br />this resolution until the City Attorney and applicants attorney <br />have a chance to review it in depth. As of this writing <br />applicants attorney was not sure whether they would be prepared <br />to make a presentation at Monday’s meeting or whether they would <br />request a further tabling. He will kn>.w on Friday and will <br />advise Council accordingly on Monday. <br />-sv
