The City Council has considered this application <br />including the findings and recommendations of the Planning <br />Comnission* reports by staff and comments of the applicant <br />and the affect of the proposed use on the health, safety, <br />and welfare of the community. <br />6. The City Council finds that granting a conditional use <br />permit ‘o allow the placement of 500 cubic yards of fill on <br />applicant's property will not be be detrimental to the <br />health, safety or general welfare of the public, would not <br />adversely affect light, air nor pose a fire hazard or other <br />danger to neighboring properties, nor will its use <br />depreciate surrounding property values and that the proposed <br />level of use of the property will be in keeping with the <br />intent and objectives of the Zoning Code and Comprehensive <br />Plan of the City. <br />OOaCLDSIOHS, ORDER. AMD COMDITIONS <br />Based upon one or more of the above findings, the Orono <br />City Council hereby grants a conditional use permit per Municipal <br />Zoning Code Section 10.03, Subdivisions 19 through 21, to permit <br />the placemens of 500 cubic yards of fill on the property, subject <br />to the following conditions: <br />1. Applicant shall adhere to the grading plan as proposed. <br />2. All disturbed areas shall be re-vegetated as soon as <br />possible upon completion of grading work. <br />3. Adequate erosion measures shall be maintained in place <br />as may be required by the City Inspector. <br />4. Applicant shall obtain an after-the-fact land alteration <br />permit Including the $75.JO after-the-fact permit fee. <br />Applicant shall further pay the $200.00 after-the-fact <br />investigation fee for the conditional use permit application <br />before the land alteration permit is issued. <br />5. Violation of or /n-compliance with any of the terms and <br />conditions of this resolution shall constitute a violation <br />of the Zoning Code, shall automatically terminate any <br />authority granted herein, and shall be punishable as a <br />misdemeanor. <br />Page 2 of 4 <br />~r>i i ^Ai jfrttf'' i It
