f. <br />t: <br />rf; ‘ ■ ■ <br />h’O'- <br />" • <br />tA, <br />o o <br />^ w ^^jyy . ^ <br />\ 4* <br />^esHot^ <br />CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />A RBSOT.0T10N GRANTING <br />AFTER-THB-FACT VARIANCES TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISION 2 AND <br />SECTION 10.25, SUBDIVISION 6(B) <br />FILE 11636 <br />WHEREAS, Steve Tibbetts (hereinafter "the applicant") is the <br />owner of the property located at 1810 Shadywood Road within the City <br />of Orono (hereinafter "City") and legally described as follows: <br />IiOt 22, Shadywood, Hennepin County, Minnesota (hereinafter the <br />property") t and <br />WHEREAS, the applicant has applied to the City for after- <br />^Ae^fact variances to Municipal Zoning Code Section 10.22, Subdivision <br />2 to permit improvements to the property that result in an excess of <br />hardcover within the 75-250' setback area at 1,684 s.f. or 12.4% where <br />only 3,375 s.f. or 25% is allowed and a side setback variance per <br />Section 10.25, Subdivision 6(B) that would allow a deck 3' 1" from the <br />side lot line instead of the required 10*. <br />Minnesota t <br />HOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #1636. <br />2. The property is located in the LR-IC Single Family Lakeshore <br />Residential Zoning District requiring 21,780 s.f. or 1/2 acre in <br />area. The property consists of approximately 18,000 s.f. <br />3. The Orono Planning Commission reviewed this application on <br />April 15, 1991 and recommended approval of the after-the-fact <br />variances as proposed based upon the following findings an <br />liardshipt <br />a) This property was granted lot area and lot width <br />variances per Resolution #1718-B on January 14, 1985. No <br />other variances were granted at that time and the conditions <br />of Resolution #1718-B specifically noted that all <br />Improvements must meet City requirements and that tie <br />hardcover must not exceed 25% in the 75-250' setback zone. <br />Page 1 of 5 <br />1
