Reserved for Recording <br />DRAINAGE EASEMENT <br />THIS DRAINAGE EASEMENT is made this__^day of 1998, by Susan K. <br />VanMoorlehem and Douglas F. VanMoorlehem, wife and husband (collectively, the "VanMoorlehems”) and <br />Kenneth Tumham and Edith L. Tumham, husband and wife (collectively, "Tumhams"; the VanMoorlehems and <br />Tumham are collectively sometimes referred to herein as "Grantors"). <br />RECITALS: <br />A. Grantors obtained approval of the plat of Tumham Toll Addition from the City of Orono, a <br />municipal corporation organized under the laws of the State of Minnesota (the "City"), and the City as a <br />condition of such approval requires this Drainage Easement. <br />NOW, THEREFORE, Grantors hereby declare and agree as follows: <br />1. Dfaiuage Easement. Grantors hereby declare a perpetual drainage easement over, across and <br />upon those portions of Lot 1, Block 1, Lot 1, Block 2, and Lot 1, Block 3, Tumham Toll Addition, accCiXling to <br />the recorded plat thereof, owned by them as set forth and legally described on Exhibit A and depicted on Exhibit <br />A"1 attached hereto (the "Easement Areas"). <br />2. Restrictions. Except as permitted herein: <br />A. No trees, shmbs or other vegetation shall be destroyed, cut or removed from the <br />Easement Areas except as authorized by written consent of the City. <br />B. No earth, loam, peat, grave, soil or any other natural material or substance shall be moved <br />or removed from the Easement Areas and there shall be no dredging or excavation of any <br />nature whatsoever or any change of the topography of the Easement Areas without the <br />written consent of City. <br />C. No soil, sand, gravel, or other substance or material as landfill shall be placed, dumped or <br />stored upon the Easement Areas and no waste, trash or garbage shall be placed, dumped <br />or stored within the Easement Areas. <br />• « <br />20997CLB
