-> <br />J The Orono Planning Commission reviewed this application on October 19, 1998 <br />and recommended approval by a vote of 5 to 0. <br />The Planning Commission made the following findings of fact: <br />A.The lot does meet lot area and lot width requirements. The lot is only <br />required to meet 80% lot area and lot width because it is sewered and <br />was platted prior to the adoption of the zoning code. <br />B. <br />C. <br />The boathouse would remain on the property. <br />The lot shares a driveway with the adjacent property to the south, 2523 <br />Kelly Avenue. The entire shared portion of the driveway is located on <br />the 2515 Kelly Avenue lot. <br />D.The applicants have proposed to reduce hardcover on the lot from 11,494 <br />s.f to 8,798 s.f. <br />E.The Planning Commission recommended reducing hardcover in the 75- <br />250' lakeshore setback to 27%. The applicants originally proposed 28.7% <br />hardcover. <br />F.The lot is pieshaped, limiting the lot area within the 75-250' lakeshore <br />setback. <br />G.The proposed development is consistent with the development in the <br />locality'. <br />H.Letters in support of the applicant's proposal were submitted by property <br />owners at 2509, 2525, and 2523 Kelly Avenue. <br />The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variances would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicants, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial <br />Page 2 of 5
