B <br />A RESOLUTION GRANTING VARIANCES <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIVISION 9 (A); <br />SECTION 10.22, SUBDIVISION 2; <br />SECTION 10.56, SUBDIVISION 16 (L) (1) AND <br />SECTION 10.56, SUBDIVISION 16 (L) (2) <br />FILE NO. #2428 <br />WHEREAS, David Hardten and Christine Hardten (hereinafter "the applicants") <br />are the owners of the property located at 2515 Kelly Avenue within the City of Orono <br />(hereinafter "the City") and legally described as follows: <br />Tract C of R.L.S. No. 1428, Hennepin County, MN (hereinafter "the property"); <br />and <br />WHEREAS, after due published and mailed notice in accordance with Mmnesota <br />Statues and the City of Orono Zoning and Planning Codes, the Orono Planning Commission <br />held a public hearing on October 19, 1998, at which times all persons desiring to be heard <br />concerning this application were given the opportunity to speak thereon; and <br />WHEREAS, the applicants have applied to the City for variances to Mumcipal <br />Zoning Code Section 10.22, Subd. 9 (A) to permit an accessory building to remain on the lot <br />without a principal building; Section 10.22, Subd. 2 and Section 10.56, Subd. 16 (L) (1) to <br />permit 924 s.f. (6.3%) hardcover where 924 s.f. (6.3%) exists; Section 10.22, Subd. 2 and <br />Section 10.56, Subd. 16 (L) (2) to permit 6,113 s.f. (26.9%) hardcover within the 75-250' <br />lakeshore setback where 5,673.75 s.f. (25%) is allowed, and to permit 1,761 s.f. (30.6%) of <br />hardcover within the 250-500’ lakeshore setback where 1,724.4 s.f. (30%) is allowed. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Mmnesota: <br />FINDINGS <br />1. <br />*) <br />This application was reviewed as Zoning File #2428. <br />The property is located in the LR-IB Zoning District, where 1 acre or 43,560 <br />s.f. is the minimum lot area.
