ORONO CITY COUNCIL MEETING <br />MINUTES FOR OCTOBER 26, 1998 <br />(#2432 Greenfield Corporation, Continued) <br />Mayor Jabbour inquired whether the City Council would be in favor of a private driveway <br />easement. <br />It was the consensus of the City Council not to approve the private driveway easement. <br />Mayor Jabbour inquired whether the City Council would be in favor of a lot line <br />rearrangement. <br />Goeiten stated access should be provided as outlined in the resolution, noting a precedent <br />might be set if we allow a substandard lot in this subdivision. <br />Goetten moved, Peterson seconded, to deny Application #2432, 4755/4775 Bayside <br />Road denying the private driveway easement and directing the Applicant to abide by <br />the conditions outlined in the original subdivision resolution. VOTE: Ayes 4, Nays 0. <br />(#15) #2433 DORTE FINN, 1640 SHADYWOOD ROAD - VARIANCE/RESOLUTION <br />NO. 4186 <br />Dorie Finn was present. <br />Weinberger stated the Applicant has applied for several variances to allow replacement of a <br />first-story deck and stairway to the second story which was damaged in a storm. The original <br />deck was constructed in 1968, and the repairs and replacement did not change the size or <br />alter the design of the structure, but the repairs exceeded what was damaged in the storm. <br />Weinberger stated variances to hardcover are required as well as a variance to permit the <br />reconstruction of a residential deck within the lakeshore setback. <br />Weinberger commented this structure had previously been utilized as a duplex, which is no <br />longer the case. <br />Finn stated her daughter lives on the top floor and she resides on the lower floor. Finn stated <br />three footings were replaced as well as three support structures. The staircase was damaged <br />by a fallen tree and was considered to be a hazardous situation. <br />Mayor Jabbour inquired whether this structure is now legally conforming. <br />Finn remarked the residence has not been a duplex since approximately 1960. <br />Mayor Jabbour commented the duplex use of the residence cannot be reinstated <br />15
