Request for Council Action continued <br />Page 3 of 5 <br />June 17, 1998 <br />Proposed Joint Use Dock Relocation <br />house pads for the existing northerly duplex units, and one large commons outlot <br />(Outlot A, Kelly Cove). The four northerly duplex units continued to use the joint <br />use dock svstcm extendinc from Outlot A. Navarre Cove. <br />Since 1978 the City has annually issued a joint use dock license to the 6-member Navarre Cove <br />Homeowner's Association. The most recent license (1997) allows six slips on three individual docks <br />extending from Outlot A, each dock being 44' in length, fhis extension from 25' to 44' occurred <br />during the drought in the late 1980s and was formalized by LMCD and the City in 1993. <br />Current Proposal <br />While Lot 3 in N'ivarre Cove just recently received approval for demolition and reconstruction of <br />a new duplex, the owner of Lot 3 would prefer to eliminate Outlot A (the dock outlot) and make Lot <br />3 a single family lot. Lot 3 becomes much more marketable without the encroachment of Outlot A, <br />and without having to accommodate the joint use dock for the four remaining duplex units. <br />To this end, the four remaining duplex owners would like to move their four slips further north to <br />extend from their own commons outlot. This appears reasonable but also raises some additional <br />issues: <br />1. The proposed dock system will extend from an area that the City maps define as <br />wetland and over which the City has a Conservation and Flowage Easement; <br />however, staff has reviewed the status of the wetland, and it clearly is not as <br />extensive as the old maps indicate. The area from which the new dock will extend <br />is maintained as yard, contains mature trees, and obviously is high ground. The <br />actual wetland boundary is much further west than the proposed dock location. In <br />staffs opinion, the wetland is not a factor in this application. <br />2. Lot 3 as a conforming 1 acre/140' width single family lot, would likely be allowed <br />by LMCD to have as many as four slips and four boats, as long as all four boats were <br />titled to the owners of Lot 3. The net result for the City is where there were six slips <br />and six boats, there is now a potential for eight slips and eight boats. <br />Council should weigh the potential impacts of four joint use dock slips plus a single tamily dock <br />system, versus six joint use dock slips. <br />Applicant is advised to contact the LMCD (471-9588) which also has jurisdiction over joint <br />docks, to confirm what special restrictions or permits that body may require for this change.
