Request for Council Action continued <br />Page 2 of 5 <br />June 17, 1998 <br />Proposed Joint Use Dock Relocation <br />In 1977 a conditional use pcmiit application was approved, allowing tour additional <br />units (two duplex buildings) to be constructed on Tract A in addition to allowing the <br />existing fire station duplex to remain. A decision on the proposed joint use dock to <br />serve all 6 duplex units was left up in the air. pending the results of an LMCD <br />moratorium. The two new duplex buildings were constructed on Tract A in 1977- <br />78. <br />On March 30, 1978 the City of Orono issued a Joint use dock license to the "Kelly <br />Avenue Holding Company" for one slip for each of six duplex dwelling units. 1 hat <br />dock system was to be constructed near the entrance of the lagoon at the southwest <br />comer of Tract A. Please review the staff memo and exhibits for Application #350 <br />which provides some background to the discussions held regarding this initial joint <br />use dock license. <br />In 1979 Tract A was split into three lots, each containing an existing duplex building, <br />plus two outlots: Outlot A for a joint use dock, located at tlic shoreline of Lot 3; and <br />Outlot B, the platted lake bed which was then deeded to the City. <br />The 1978-79 discussions regarding lake access for these six duplex units, revolved <br />around a number of factors: <br />1. <br />2. <br />3. <br />4. <br />In total the six units had only 400' of shoreline in the LR-IB zoning district <br />that required 140' of lot width and allowed one riparian "dock right per lot; <br />i.e. the 3-acre site would only qualify for two riparian "dock rights if <br />subdivided into two confomiing widths siiigle family lots. <br />City maps designated wetland along the shoreline of Lots 1 and 2, and <br />allowing a dock to extend from Lots 1 and 2 would require a variance to the <br />flood plain and wetlands ordinance which was then recently adopted. <br />A joint use dock providing one slip for each of the six duplex units would be <br />of less impact than six individual docks. The impact of six slips, one for each <br />of six duplex dwelling units, was considered a reasonable impact on the <br />neighborhood and the lagoon. <br />Three indi\'idual docks limited to 5'6" width by 25' length, with two boats <br />slipped at each dock, and such docks grouped at the southwest end ot the <br />property, would be appropriate. <br />In 1984, Lots 1 and 2 of Navarre Cove w ere replattcd as "Kelly Cove" creating four
