Plumbing in Accessory Buildings <br />October 8,1998 <br />Page 2 <br />There is always a potential that an accessory building with a toilet/bathtub/shower that is intended <br />for something other than dwelling use, will occasionally be used as a? added bedroom for short term <br />stays, say when relatives come to stay for a few days or a week. But if a relative stays there all <br />summer, that building has become a guest house. <br />The zoning code does not differentiate between "occasional overnight use" and "gaest house use". <br />If an accessory building has all the basic amenities to be used as a dwelling ("provisions for sleeping, <br />eating, cooking and sanitation" according to the Building Code) at what level of use does it actually <br />become a dwelling? Absent some clear distinction, we expect there will be a few cases where <br />someone crosses over the line. <br />One possible way to create a distinction would be to prohibit overnight stays entirely unless a Guest <br />House CUP is obtained. Council may wish to consider whether such a limitation should be added <br />to this ordinance. <br />Revised Draft Ordinance Outline <br />Following is an outline of the key points of the redrafted ordinance: <br />1. <br />2. <br />3. <br />4. <br />Water supply plumbing is allowed in any accessory building that is conforming in location, <br />size and height, regardless of lot size, via staff issued permit without Council approval. <br />Wastewater plumbing (except for toilet or shower or bathtub or a combination of same) is <br />allowed in any accessory building that is conforming in location, height and size, regardless <br />of lot size, via staff issued permit without Council approval, subject to covenants which <br />prohibit home occupation use, secondary dwelling use except by guest house CUP, or rental <br />dwelling use. <br />Wastewater plumbing when such includes a toilet shower, bathtub or a combination of same, <br />shall be allowed only via a "Plumbing in Accessory Building CUP" when such accessory <br />structure is on a lot that is 2.0 acres or larger in area and is not intended to be used as a guest <br />house; or via a valid "Guest House CUP" that has been approved by the City Council. <br />A "Plumbing in Accessory ’ Building CUP" may be approved by Council only when Council <br />finds: <br />- the use of the structure is appropriate in the neighborhood; <br />- the plumbing fixtures proposed are appropriate for the intended use; <br />the lot area is at least 2.0 acres; <br />the accessory building is in a conforming location as to setbacks; and <br />- the property owner agrees to filing of a covenant with restrictions as described <br />in #2 above.
