The primary revisions discussed were: <br />1.Limit applicability of the ordinance (or at least the toilet/tub/shower CUP provisions) <br />to properties of 2 acres in area or larger, regardless of the zoning district; <br />2. Limit applicability to structures that are conforming in location. <br />Exhibit A is a revised ordinance draft that incorporates the above revisions. The wording and order <br />of sentences has been slightly revised to be more 'user friendly'. <br />Staff was concerned that a provision strictly limiting applicability to only those properties 2.0 acres <br />or larger, would be in conflict with the City's ordinance that allows Council to grsuit a guest house <br />CUP for a property that meets the 'double the zoning district minimum lot area' requirement. For <br />instance, a 1-acre lot in a 1/2-acre zone might otherwise qualify for a guest house CUP under the <br />Guest House ordinance, and therefore should not be prohibited under the Plumbing In Accessory <br />Buildings ordinance. The language has been drafted to address this. <br />Guest House CUP vs. Plumbing in Accessory Buildings CUP <br />The proposed ordinance is intended to provide an alternative to the Guest House CUP for the <br />property owner who has no intent to use the accessory building as a guest house. The Guest House <br />CUP was/is intended for an accessory building that is set up as a freestanding dwelling, containing <br />all the amenities necessary to live there without having to 'go up to the main house' for anything.
