COUNCIL r
i REQUEST FOR COUNCIL ACTION
OCT 1 2 199
CITY cr ORONO
Date: October 8,1998
Item No• •
Department Approval: Administrator Approval:
Name: Michael P. Gaffron
Title: Senior Planning Coordinator
Agenda Section:
Zoning
Item Description: Revised Version - Plumbing In Accessory Buildings Ordinance - Adoption
List of Exhibits
A - Revised Ordinance for Adoption
B - Memo & Selected Exhibits of September 24,1998
C - Draft Covenant for Limited Wastewater Plumbing
On September 28 Council tabled discussion of the 'Plumbing in Accessory Buildings' ordinance after
directing staff to consider a number of revisions. The primary revisions discussed were:
1.Limit applicability of the ordinance (or at least the toilet/tub/shower CUP provisions)
to properties of 2 acres in area or larger, regardless of the zoning district;
2. Limit applicability to structures that are conforming in location.
Exhibit A is a revised ordinance draft that incorporates the above revisions. The wording and order
of sentences has been slightly revised to be more 'user friendly'.
Staff was concerned that a provision strictly limiting applicability to only those properties 2.0 acres
or larger, would be in conflict with the City's ordinance that allows Council to grsuit a guest house
CUP for a property that meets the 'double the zoning district minimum lot area' requirement. For
instance, a 1-acre lot in a 1/2-acre zone might otherwise qualify for a guest house CUP under the
Guest House ordinance, and therefore should not be prohibited under the Plumbing In Accessory
Buildings ordinance. The language has been drafted to address this.
Guest House CUP vs. Plumbing in Accessory Buildings CUP
The proposed ordinance is intended to provide an alternative to the Guest House CUP for the
property owner who has no intent to use the accessory building as a guest house. The Guest House
CUP was/is intended for an accessory building that is set up as a freestanding dwelling, containing
all the amenities necessary to live there without having to 'go up to the main house' for anything.
