COUWCIL <br />OCT 1 2 1998 <br />REQUEST FOR COUNCIL ACTION crn'crcR'/^ij <br />DATE: 10/9/98 <br />ITEM NO.: <br />Department Approval: Administrator Reviewed: Agenda Section: <br />Name Paul Weinberger Zoning <br />Title Assistant Zoning Administrator <br />Item Description:#2418 Robert Lund on behalf of Graydon and Michelle Newman <br />1655 Bohn's Point Road <br />Variances--Public Hearing <br />Zoning District:LR-IB One Family Lakeshore Residential District (1 Acre) <br />Lot Area:70,881 square feet (1.62 acres) <br />The City Council voted 5 to 0 to deny the variances requested by Robert Lund on behalf of Graydon <br />and Michelle Newman, 1655 Bohns Point Road, to allow an average lakeshore setback variance for <br />a pool structure and an average lakeshore setback for a 30' tower to be constructed on the lakeside <br />of the home for a first floor open porch with office space above. The applicant also intended to <br />receive a hardcover variance to allow 11,605 s.f. of coverage in the 75-250’ lakeshore setback. <br />Mr. Lund x^-ill be present at the October 12, 1998 City Council meeting to request clarification of <br />the action taken on September 28, 1998 to deny his request on behalf of Graydon and Michelle <br />Nevraian. He has submitted several exhibits that are attached to this memo for discussion on <br />Monday night. <br />2. <br />A residence existed on the lot at the time the City Council granted a hardcover <br />variance on July 28, 1997 (DWG-1). The City Council granted a variance for <br />hardcover to not exceed 11,603.5 s.f. (26.7%) meeting the conditions that were <br />legally existing on the property prior to removal of the proposed residence. <br />The City Council granted variances on July 28, 1997 to allow the residence to <br />encroach into the average lakeshore setback, and to allow 11,606 s.f. (26.7%) of <br />hardcover in the 75-250' lakeshore setback where 10,850 s.f. (25%) is allowed and <br />11,606 s.f. (26.7%) existed at the time of application. Approval was in accordance <br />with the survey and site plan submitted with Zoning Application #2265 on file with <br />the City of Orono Department of Building and Zoning, dated February 12 1996 <br />(DWG-2).
