CITYof ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 2982_ _ _ _ _ <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon the above findings, the Orono City Council hereby <br />grants a variance to Municipal Zoning Code Section 10.03, Subdivision <br />14 (C) and Section 10.28, Subdivision 5 (B) to permit the construction <br />of a 16' X 20' deck with 4' x 10' stairway, located 22' from the left <br />side lot line where a 30' setback is normally required, 11.3' from the <br />north side street lot line where a 50' setback is normally required, <br />and 28' from the rear lot line where a 50' setback is normally <br />required, and grants a variance to allow 22% lot coverage where only <br />15% lot coverage is normally allowed, subject to the following <br />conditions: <br />1. Applicant is advised that future proposals to increase lot <br />coverage by structures on this property will not be looks <br />upon favorably by the Council. <br />2. Applicants shall construct the deck per the approved plans. <br />Any changes from those plans which increase the size or <br />extent of the deck shall be subject to further City review. <br />3. Authorities granted by this variance run with the property <br />not with the applicant, but are permissive only and must be <br />exercised by application for a building permit within one <br />year of the date of Council approval, or this variance will <br />expire on that date (July 8, 1992). <br />4. Violation of or non-compliance with any of the terms and <br />conditions of this variance shall constitute a violation of <br />the zoning code, shall automatically terminate any authority <br />granted herein, and shall be punishable as a misdemeanor. <br />5. The undersigned applicant has read, understood and hereby <br />agrees to the terms of this resolution ano on behalf Oi <br />himself, his heirs, successors and assigns, hereby agrees to <br />the recording of this resolution in the chain of title Oj. <br />the property. <br />Page 3 of 5
