CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 2982 _________ <br />and except for tne proposea sraiiway unc <br />of the deck/ encroaches no closer to the street than <br />the existing house. <br />c) The proposed deck replaces a pre-existing deck of <br />slightly smaller square footage in the same location. <br />d) Without this deck/ two of the three main doorway <br />entrances to the residence will become only marginally <br />useable due to their elevation above grade. <br />4. The property does not contain a garage. Zoning Code Section <br />10.03/ Subdivision 14 (C) allows lot coverage by principal <br />residence and garage structures of at least 1500 s.f. for <br />any developed property/ regardless of the resultant lot <br />coverage percentage. In this case/ the variance is <br />necessary because for lot coverage purposes the deck is not <br />considered part of the principal residence. However/ <br />granting of the lot coverage variance is justified on the <br />basis that replacement of a pre-existing deck structure will <br />not tend to increase the visual density of the neighborhood. <br />5. The City Council has considered this application including <br />the findings and recommendations of the Planning Commission/ <br />reports by City staff/ comments by the applicant and the <br />effect of the proposed variance on the health/ safety and <br />welfare of the community. <br />6. The City Council finds that the conditions existing on this <br />property are peculiar to it and do not apply generally o <br />other property in this zoning district; that granting the <br />variance would not adversely affect traffic conditions/ <br />light/ air nor pose a fire hazard or other danger to <br />neighboring property; would not merely serve as a <br />convenience to the applicant/ but is necessary to alleviate <br />a demonstrable hardship or difficulty; is necessary o <br />preserve a substantial property right of the applicant; and <br />would be in keeping with the spirit and intent of the Zoning <br />Code and Comprehensive Plan of the City. <br />Page 2 of 5
