He indicated the imposition of a maximum fee would provide some <br />certainty. He also noted that the Executive Session is only being held because oft <br />threat of litigation from this application. <br />The applicant was present along with attorney, Steve Pflam. <br />Gaffron reported that the application is for preliminary subdivision and the conversion of <br />Outlot E, Sugar Woods, to buildable statui The outlot was created from a parcel ot land <br />remaining from the Sugar Woods plat for future commercial development consisting ot <br />Outlots E and F, which is the Orono Shopping Center. At the time of the plat, a <br />comprehensive plan amendment included a frontage road to serve projected commercial <br />development. The Sugar Woods plat conformed to that amendment with the creation of <br />Outlot D This outlot only provides a corridor from the west boundary of Sug^ Woods <br />to the northwest comer of Outlot F. The intent was that at some future time when oudot <br />F is developed, the remaining frontage road segment eastward to Brown Road would be <br />defined and platted. Outlot D was platted because the City needed a ^rridor that would <br />traverse the Wear property located between Outlots E and F. Outlot C of East Willow <br />Woods was platted, providing a corridor connecting from Outlot E of Sugar Woods, <br />westward to Willow Drive for future frontage road. <br />O <br />i <br />4 <br />'I <br />1
