ANALYSIS <br />Variance <br />STATEMENT OF HARDSHIP <br />The applicant's have included their statement of hardship in Exhibit A. The applicant should also <br />be asked for their testimony regarding this issue. <br />Surrounding Properties <br />The residence to the North of the applicant's property sits on a hill located above the proposed area <br />to be fenced. The adjacent residence is configured on the lot to look straight out over their own <br />property. The fence would be visible to the property as it would be located on the property line <br />between the house and the lake. <br />Adjacent to the subject lot, to the southeast, is a small bay. The bay contains several docks and boat <br />covers. There are three residences across the bay that would not be affected by the fence as the fence <br />would be located in a wooded area. There is a wooded area between the applicants property and the <br />bay as well as several boat canopies screening the properties on the bay. <br />Allowed Fencing <br />The applicant would be allowed to construct a 3 1/2 foot fence. Lakeshore lots only allow 6' fences <br />in side yards and along the street. No fences are allowed within 75' of the lakeshore. Please see <br />Attachment F for City of Orono Fence Regulations. <br />Issues <br />1.The fence could be constructed 3 1/2 feet in height.
