The fence would be 6' in height. The applicant has <br />stated in his hardship statement 3 1/2' is inadequate for the purposes of containing his 2 Borzois <br />dogs. The proposed location has house access, where placing the fence elsewhere would not allow <br />this convenience. <br />Tl.is application requires the following variance: <br />1. To allow a fence to encroach into the average lakeshore setback. (Section 10.03, Subd. 15, <br />Paragraph D). The zoning code does not allow fences to exceed 3 1/2' within the average lakeshore <br />setback. This lot is located with one adjacent residence to the North and a small bay to the South. <br />The average lakeshore setback would be measured as the distance from the one adjacent residence <br />to the lakeshore. <br />Pertinent Ordinances: <br />Section 10.03, Subd. 15(D): Non-Encroachments <br />Section 10.56.
