Gaffiron
Title: Senior Planning Coordinator
Item Description; #2388 Wyatt & Nancy Moe, 1220 Loma Linda Avenue/1230 Spruce Place
Vacation of Portland Place - Resolution
Zoning District: LR-IB, Single Family Lakeshore Residential, 1 acre, sewered.
Proposal: Vacate portions of Portland Place which the City assumed it had vacated in 1979.
List of Exhibits
A - Resolution
B - Letter from Minnegasco
C - Notice of Planning Conunission Action 7/21/98
D - Memo and Exhibits of July 15,1998
Please review the memo and exhibits of July 15. Briefly, applicants request the vacation of porti^s
of Portland Place which lie between their properties in Blocks 1 and 2 of Saga Hill Revised. The
history of this is detailed in the staff memo of July 15.
Minnegasco has indicated they have a gas main within the right-of-way being vacated and have
indicated an easement will be required. It also appears that overhead utility lines are in place
the right-of-way, although we have not heard from the other utility companies which were notified
by mail on July 8. The City has sewer lines within the right-of-way which will require a utility
easement. The City Attorney is investigating whether the necessary easements can be reserved
within the vacation resolution, instead of having to be appended documents as currently drafted.
Planning Commission Recommendation
Pursuant to the required 2-week notice a public hearing was held by the Planning Commission on
July 20, 1998. The third parcel affected directly by the vacation was represented by the owner,
Carolyn Udell, who was in favor of the vacation. Planning Commission voted 6-0 to recommend
approval per the staff recommendation, including;
1.Approval of the vacation of that portion of Portland Place located between Blocks
1 and 2, Saga Hill Revised, adjacent to the Moe and Udell properties only.
