A variance for lot with is required. The applicant also wishes to retain <br />the existing residence as an accessory structure. This is a renewal of an elapsed variance. The <br />proposal had previously been approved by the City Council as application il^l92 in November <br />1996 with the stipulation that all plumbing and heating facilities be removed from the current <br />principal structure prior to the issuance of a certificate of occupancy for the new principal <br />structure. <br />PLANNING COMMISSION RECOMMENDATION: <br />The applicants appeared at the Planning Commission meting and objected to the conditions of the <br />previous resolution regarding the removal of the heating system. <br />Planning Commission recommended by a 4 to 0 vote to renew the elapsed variance to: <br />1.Approve a lot width variance allowing the lot to remain at 74.89' at the OHWL and <br />83' at the 75' setback where 140' is required. <br />2.Prior to the issuance of the certificate of occupancy for the new residence, all <br />plumbing and heating facilities must be removed from the current principal <br />structure. A restrictive covenant must also be signed to prevent the future use <br />of the current residence as living space. <br />COUNCIL ACTION REQUESTED: <br />To approve or amend the enclosed resolution.
