1 <br />4. The Planning Commission made the following findings of fact: <br />a. The proposed repair work is in compliance with the objectives of the <br />zoning code and the LR-IB district. <br />b. The repair work will not change the size or location of the structure. <br />5. <br />c. <br />d. <br />The repair work is necessary to retain the property owner's interest in the <br />property. <br />The work below the ordinary high water level (OHWL) will not have a <br />negative impact on the lake or environment. <br />The City Council finds that granting a conditional use permit will not be <br />detrimental to the health, safety or general welfare of the public, would not <br />adversely affect light, air nor pose a fire hazard or other danger to neighboring <br />properties, nor will its use depreciate surrounding property values and that the <br />proposed level of use of the property will be in keeping with the intent and <br />objectives of the Zoning Code and Comprehensive Plan of the City. - <br />The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicant and the effect of the proposed conditional use permit on the <br />health, safety and welfare of the community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby <br />grants a conditional use permit per Municipal Zoning Code Section 10.09, and Section 10.56, <br />Subdivision 3 (29) to permit repair to the structural support of an existing boathouse where a <br />conditional use permit is required to work below the ordinary high water level, subject to the <br />following conditions: <br />1. The size of the boathouse structure shall not be increased. <br />2. The construction shall conform to building code requirements. <br />Page 2 of 4
