A RESOLUTION GRANTING <br />A CONDITIONAL USE PERMIT <br />PER MUNICIPAL ZONING CODE <br />SECTION 10.09, AND SECTION 10.56, SUBDIVISION 3 (29) <br />FILE NO. 2376 <br />WHEREAS, Richard W. and Marion Brown (hereinafter the "applicants") are <br />the owners of the propcity located at 2376 Shadywood Road within the City of Orono <br />(hereinafter "City") and legally described as: <br />Lot 24, Pheasant Lawn, Hennepin County, Minnesota (hereinafter "property"); <br />and <br />WHEREAS, after due published and mailed notice in accordance with Minnesota <br />Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning Commission <br />held a public hearing on June 15, 1998, at which times all persons desiring to be heard <br />concerning this application were given the opportunity to speak thereon; and <br />WHEREAS, the applicant has applied to the City for a conditional use permit <br />to Municipal Zoning Code Section 10.56, Subdivision 3 (29) to permit repair work to level an <br />existing boathouse by replacing structural support posts. A conditional use permit is required <br />to work below the ordinary high water level (OHWL). <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />3. <br />FINDINGS <br />This application was reviewed as Zoning File #2376. <br />The property is located in the LR-IB Zoning District, where 1 acre is the <br />minimum lot area. The property consists of 1.18 acre or 51,777 sq. ft. <br />The Orono Planning Commission reviewed this application on June 15, 1998 and <br />recommended approval of a vote of (7 to 0). <br />Page 1 of 4
