FERNDALE ROAD <br />IMPROVEMENT AGREEMENT <br />AGREEMENT made this day of , 1998, by and <br />between the CITY OF PLYMOUTH, a Minnesota municipal corporation ("Plymouth") <br />and the CITY OF ORONO, a Minnesota municipal corporation ("Orono"). <br />1. PURPOSE. Pursuant to Minn. Stat. § 471.59 the parties to this Agreement <br />intend to jointly undertake certain improvements to Ferndale Road between County Road <br />6 and Highway 12 (the "Project"). <br />2. FEASIBILITY REPORT. Bonestroo, Rosene, Anderlik & Associates, Inc. <br />("Bonestroo") has prepared a feasibility report on the Project dated April 8, 1998. The <br />feasibility report is approved subject to the following: <br />• Street Width: 28 feet wide with an additional turn lane at County Road 6. <br />• Walk: 8 feet wide immediately adjacent and along the east curb. <br />• Curb: vertical curb. <br />3. PLANS AND SPECIFICATIONS. Plymouth shall contract with Bonestroo <br />to prepare plans and specifications for the Project consistent with Minnesota Department <br />of Transportation state aid standards, the feasibility report, and this Agreement. The <br />plans and specifications must be approved by both parties before proceeding to bidding. <br />4. RIGHT-OF-WAY ACQUISITION. Each city shall be responsible for <br />acquiring at its own cost any additional easements necessary for Project construction <br />within its corporate boundaries. <br />5. BIDDING AND CONTRACTING. Plymouth shall prepare necessary <br />contract documents and bid the Project consistent with the requirements of Minn. Stat. <br />Chapter 429. If an acceptable bid is received, Plymouth shall award a contract for the <br />Project and shall administer the contract. Plymouth may approve change orders <br />consistent with the plans and specifications and Minn. Stat. Chapter 429. Plymouth will <br />provide to Orono, at the earliest possible time, information regarding potential change <br />orders and approved change orders. <br />6. COST SHARING. Excluding staff time and the cost of right-of-way <br />acquisition, if any, the cost of the Project shall be allocated fifty percent (50%) to <br />Plymouth and fifty percent (50%) to Orono.
