r <br />6. <br />I! <br />7. <br />8. <br />The conditions do not apply generally to other land or structures in the district <br />in which said land is located. <br />The lot depth is 64.72' where 129.48' is existing for most lots in the area. This makes <br />meeting the front and rear setbacks for the subject property impossible. <br />The granting of the application is necessary for the preservation and enjoyment <br />of a substantial property right of the applicant. <br />The existing residence could not be improved by expanding it upward or outward without <br />the granting of the necessary yard setback variances. <br />The granting of such variance will not merely serve as a convenience to the applicant, <br />but is necessar)' to alleviate demonstrable hardship or difficulty. <br />The existing one story residence has a footprint of695 s.f with no garage. By adding a <br />second story and one stall attached garage, the livability of the residence will be greatly <br />improved. <br />Issues <br />1. The property does not meet lot area or width requirements. <br />2. The existing residence encroaches into the required front, side and rear yard setbacks. <br />3. <br />4. <br />5. <br />There is currently no garage on the property. The one stall attached garage as proposed has <br />the minimal footprint to be functional as it would not be feasible if its footprint was reduced. <br />The sur\’ey shows the garage addition encroaching 3.2' closer into the front setback than the <br />existing residence. The elevation drawings show the front overhang of the garage even with <br />first level overhang of the residence. The applicant should note that all other overhangs <br />extending beyond 1.5' will count as further encroachments on required setbacks. It is <br />unclear how much the awning will further encroach on the front setback as the elevation <br />drawings are not scaled. <br />While Hanlon Avenue is platted as 60' wide, the actual maintained street is approximately <br />18' wide and it will likely not be wid'jned in the future.
