A RESOLUTION DENYING <br />A CONDITIONAL USE PERMIT <br />PER MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIVISION 21.3 <br />FILE ^2290 <br />N <br />WHEREAS, the City of Orono is a municipal corporation organized and existing <br />under the laws of the State of Minnesota; and <br />WHEREAS, pursuant to State Statutes 412 et. seq. and 462 et. seq., the City Council <br />of the City of Orono has adopted zoning regulations for the protection of the public health, safety <br />and general welfare; and <br />WHEREAS, Steve and Elaine Silus (hereinaaer "the applicants") property owners <br />of 3235 Casco Circle within the City of Orono (hereinafter "the City") and legally described as <br />follows; <br />Lot 19, Spring Park, also all that part of vacated Lakeshore Avenue and of the tract of land <br />lying between said vacated avenue and Lake Minnetonka which lie between the easterly <br />extensions of the northerly and southerly lying of said Lot 19; and (hereinafter "the <br />property"); and <br />WHEREAS, the applicant has applied to the City for a conditional use permit per <br />Municipal Zoning Code Section 10.03, Subdivision 21.3, to permit grading within 5' of the southerly <br />property line to allow for a driveway and retaining wall to be located 2' from the property line; and <br />WHEREAS, the Orono Planning Commission after due public notice held a public <br />hearing on January 20, 1998, to review the application, at which time the applicant, and all other <br />interested members of the public were allowed to comment on the proposed application; and <br />Page 1 of3 <br />^ ••' *i*- j
