CITY COUNCIL MEETING HELD MARCH 25, 1991 <br />GHTS DRAINAGE CONTINUED <br />matteir was tabled to allow time for Council toWHt)NAVAR]^J||U <br />letter. Bernhardson explained the proposec project, <br />noting that the project costs would be assessed to residents in <br />the area of the project at an estimated cost of $7i)0 per lot. He <br />asked Glenn Cook to display the overhead showing the project <br />area. He said, "This project called for the installation of <br />storm sewer pipe from Livingston A/enue through what is known as <br />the Cuff property to Crystal Place. At the Public Hearing last <br />Fall, there was concern regarding drainage on the north side of <br />t.he railroad tracks and Togo Road. That issue was reviewed by <br />the City Engineer who determined that installing the pipe on <br />Livingston would not increase the drainage problem on Togo Road." <br />Cook used the sketch to show the drainage pattern in the <br />Livingston Avenue area and how it drained under the railroad <br />tracks to the Togo Road area. He indicated that the property <br />owners of Lot 14 ( 3637 Togo Road) are experienci ig the most <br />severe water problems in the Togo R jad area. He said, We <br />discussed their water problems with them and will work with them <br />to try to improve drainage o/er their property. The water <br />problems for that property will not change if the Livingston <br />Avenue project is done." <br />Bernhardson reviewed the process that would occur following <br />this Public Hearing, if in fact the Council votes to advertise <br />for bids. <br />Mayor Peterson explained the procedure to follow for those <br />wishing to participate .'.n the Public Hearing. She then <br />recognized Tony Gleekel, the Attorney for Mark and Karen Cuff. <br />Gleekel referred to his March 20, 1991 letter which he had <br />.sent to the City and asked Council if they had received and <br />reviewed that letter. <br />Council indicated that they had read Gleekel's March 20, <br />1991 letter. <br />Gleekel said, "I would hope that a final decision would be <br />made this evening to advertise for bids and that the matter not <br />be tabled. Since the December 10, 1990 Public Hearing, new <br />circumstances have risen, which support the Cuff's claim that <br />they have a water drainage problem. Tne Cuffs have had to pay <br />approximately $15,000 to repatr the foundation of their home <br />which has suffered extensive water damage. The Cuffs house sits <br />fairly low in relation to neighboring properties. The only way <br />that drainage problems resulting from that situation can be <br />addressed is by installing an underground pipe. Other <br />alternatives have been explored throughout tine review of this <br />issue and it has been determined that there really are none. <br />- 2 -
